Article 1 - Purpose
These terms and conditions govern the sale of climbing accessories by the company YYVERTICAL, located at 312 rue des Meunières, 38660 Saint Vincent de Mercuze.
Article 2 - Prices
The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise stated, and exclude processing and shipping costs.
In the event of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of YYVERTICAL. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the relevant authorities and bodies in your country. We advise you to check with your local authorities for information on these matters.
All orders, regardless of their origin, are payable in euros.
YY VERTICAL the right to change its prices at any time, but the product will be invoiced on the basis of the price in force at the time of order confirmation and subject to availability.
The products remain the property of YY VERTICAL full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

YYVERTICAL reserves the right not to register a payment and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem or a problem with the order received.
Article 4 - Confirmation of your order
Any order placed on the website http://www.yyvertical.comsupposeimplies acceptance of these Terms and Conditions.
Any confirmation of an order implies your full and complete acceptance of these general terms and conditions of sale, without exception or reservation.
All data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of this.
The order confirmation will serve as a signature and acceptance of the transactions carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the email address used to confirm your order.
Article 5 - Payment
By confirming your order, you agree to pay the price indicated.
Payment for your purchases is made by credit card using the secure Wix system.
Your card will only be debited when your order is shipped. In the case of split deliveries, only the products shipped will be debited.
Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, you are liable. Any damage to the product during this process may invalidate the right of withdrawal.
You are responsible for the return shipping costs.
If you exercise your right of withdrawal, YYVERTICAL will refund the amounts paid within 14 days of notification of your request, using the same payment method used when placing the order.
The provisions relating to the right of withdrawal do not apply to packages automatically returned to the sender due to a delivery failure attributable to the customer, as described in Article 8.2 - Undelivered packages and automatic returns (passive returns).
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
The provision of services fully performed before the end of the withdrawal period and whose performance began after the consumer's prior express agreement and express waiver of their right of withdrawal.
The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and which are likely to occur during the withdrawal period.
The supply of goods made to the consumer's specifications or clearly personalized.
The supply of goods which are likely to deteriorate or expire rapidly.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed upon at the conclusion of the contract depends on market fluctuations beyond the control of the professional.
The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.
Transactions concluded at a public auction.
The supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.
Article 7- Disponibilité
Nos produits sont proposés tant qu'ils sont visibles sur le site http://www.yyvertical.comet dans la limite des stocks disponibles. Pour les produits non stockés, nos offres sont valables sous réserve de disponibilité chez nos fournisseurs.
En cas d'indisponibilité de produit après passation de votre commande, nous vous en informerons par mail. Votre commande sera automatiquement annulée et aucun débit bancaire ne sera effectué.
En outre, le site Internet n'a pas vocation à vendre ses produits en quantités importantes. Par conséquent la société <b>YYVERTICAL</b> se réserve le droit de refuser les commandes de articles identiques.
Article 8.1 - Livraison
Les produits sont livrés à l'adresse de livraison indiquée au cours du processus de commande, dans le délai indiqué sur la page de validation de la commande.
En cas de retard d'expédition, un mail vous sera adressé pour vous informer d'une éventuelle conséquence sur le délai de livraison qui vous a été indiqué.
Conformément aux dispositions légales, en cas de retard de livraison, vous bénéficiez de la possibilité d'annuler la commande dans les conditions et modalités définies à l'article L 138-2 du Code de la Consommation. Si entre temps vous recevez le produit nous procéderons à son remboursement et aux frais d'acheminement dans les conditions de l'article L 138-3 du Code de la Consommation.
En cas de livraisons par une transporteur, la société YYVERTICAL ne peut être tenue pour responsable de retard de livraison dû exclusivement à une indisponibilité du client après plusieurs propositions de rendez-vous.
Article 8.2 - Undelivered parcels and automatic returns (passive returns)
A package may be returned to YY VERTICAL having been delivered to the customer, particularly in the following cases:
– customer absent at the time of delivery,
– package not collected within the specified time frame at the pickup point,
– error or inaccuracy in the delivery address provided by the customer,
– package refused by the recipient.
When the return is due to an error on the part of the carrier (loss, incorrect delivery, damage), the customer is invited to contact customer service at hello@yyvertical.com so that an appropriate solution can be proposed (new shipment or refund).
When the return is attributable to the customer, the order will be considered returned by operation of law. Upon receipt of the package by YY VERTICAL, the customer will be refunded the amount of the returned items, excluding delivery costs, via the payment method initially used.
Any new shipment of the product(s) will require the customer to place a new order.
Article 9 - Garantie
Tous nos produits bénéficient de la garantie légale de conformité et de la garantie des vices cachés, prévues par les articles 1641 et suivants du Code civil. En cas de non-conformité d'un produit vendu, il pourra être retourné, échangé ou remboursé.
Toutes les réclamations, demandes d'échange ou de remboursement doivent s'effectuer par mail à hello@yyvertical.com ou directement dans votre espace mon compte sur le site Internet yyvertical.com dans le délai de 90 jours de la livraison.
Les produits doivent nous être retournés dans l'état dans lequel vous les avez reçus avec l'ensemble des éléments (accessoires, emballage, notice...). Les frais d'envoi d'une commande renvoyée ne vous seront pas remboursés et les frais de retour vous seront remboursés sur présentation des justificatifs si nécessaire.
Les dispositions de cet Article ne vous empêchent pas de bénéficier du droit de rétractation prévu à l'article 6.
Article 10 - Responsabilité
Les produits proposés sont conformes à la législation française en vigueur. La responsabilité de la société <b>YYVERTICAL</b> ne saurait être engagée en cas de non-respect de la législation du pays où le produit est livré. Il vous appartient de vérifier auprès des autorités locales les possibilités d'importation ou d'utilisation des produits ou services que vous envisagez de commander.
Par ailleurs, la société YYVERTICAL ne saurait être tenue pour responsable des dommages résultant d'une mauvaise utilisation du produit acheté.
Enfin la responsabilité de la société YYVERTICAL ne saurait être engagée pour tous les inconvénients ou dommages inhérents à l'utilisation du réseau Internet, notamment une rupture de service, une intrusion extérieure ou la présence de virus informatiques.
Article 11 - Droit applicable en cas de litiges
La langue du présent contrat est la langue française. Les présentes conditions de vente sont soumises à la loi française. En cas de litige, les tribunaux français seront les seuls compétents.
Article 12 - Propriété intellectuelle
Tous les éléments du site http://www.yyvertical.comsont et restent la propriété intellectuelle et exclusive de la société YYVERTICAL. Nul n'est autorisé à reproduire, exploiter, rediffuser, ou utiliser à quelque titre que ce soit, même partiellement, des éléments du site qu'ils soient logiciels, visuels ou sonores. Tout lien simple ou par hypertexte est strictement interdit sans un accord écrit exprès de la société YYVERTICAL
Article 13 - Données personnelles
La société YYVERTICAL se réserve le droit de collecter les informations nominatives et les données personnelles vous concernant. Elles sont nécessaires à la gestion de votre commande, ainsi qu'à l'amélioration des services et des informations que nous vous adressons.
Elles peuvent aussi être transmises aux sociétés qui contribuent à ces relations, telles que celles chargées de l'exécution des services et commandes pour leur gestion, exécution, traitement et paiement.
Ces informations et données sont également conservées à des fins de sécurité, afin de respecter les obligations légales et réglementaires.
Conformément à la loi du 6 janvier 1978, vous disposez d'un droit d'accès, de rectification et d'opposition aux informations nominatives et aux données personnelles vous concernant, directement sur le site Internet.
Article 14 - Archivage Preuve
YYVERTICAL will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.
YYVERTICAL's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
